Criminal record

Hi guys, up until a few days ago my plans to retire in Thailand were set in stone. Recently my sister was the victim of a violent assault by a couple, being hit in the face with a brick completely unprovoked. Long story short I went to her assistance and have been charged with 1 count of aggregated break & enter and 2 counts of assault occasioning actual bodily harm (the guy ran inside his house and I chased him technically making it break & enter). I live in Australia. Now whilst we are going to fight the charges on self defence, I’m wondering if that fails will I be denied entry long term into Thailand? My plan was to semi retire in around 8-10yrs time.

I don't think Thailand has any restrictions , they only care about the contents of your Bank Account

Get your lawyer to get you a Spent conviction.

I'm in Thailand now with similar charges in Australia and had no issues getting a STV. The STV asked for police clearance. If you can get a spent conviction it will not show up on the AFP police clearance.

Almost a similar account to what a friend of mine went through.

His sister had a violent husband. They knew he was beating her, but it was one of those Stockholm Syndrome relationships where she was protecting him. One day my mate goes to visit and the door is wide open. He hears commotion, walks in and he's beating the shit out of her. So he runs to his car, grabs a tyre iron and caves his head in. Dude spent 6 months in a coma and had to have plates put in his head.

My mate spent 2 years behind bars.

SE is right though. I know for a fact that there are plenty of expats there with criminal records of all sorts. So obviously either not an issue, or there are easy ways around it. Probably does involve your wallet 55.

Thanks for the advice mate, I’ll run that past her. I’m told it’s a pretty serious charge though very low on the criminality level. I’m hoping to get it quashed ultimately but as you’re probably aware the justice system in Australia favours the criminals not the victims so I’m trying to prepare for the worst.

There's a statute of limitations(that the right term or other way around?) on Spent Conviction reports though. When did this happen?

i was charged with this on Thursday just gone. It goes to court for the initial thing in a few weeks. Then it’s off to district court to go to trial. I’m told it’s a serious indictable offence which apparently hold an automatic jail term, though my solicitor assures me I won’t be going inside.

Sorry to hear. This is a lot of crappy stress and angst that no one needs.

Marge: I thought you said the law was powerless.
Chief Wiggum: Powerless to help you, not punish you!
